Terms of Service

1. Definitions & Parties

"Lane Pilot LLC" refers to Lane Pilot LLC, a single-member limited liability company organized under the laws of the Commonwealth of Pennsylvania (State Entity ID 0015441791), with its registered office at 502 W 7th St Ste 100, Erie, PA 16502.

"Service" refers to the Lane Pilot platform, including its browser-based application, installable web app, APIs, Diagnostic Engines, and related documentation provided by Lane Pilot LLC.

"User," "You," or "Your" refers to any individual or entity that accesses or uses the Service.

2. Acceptance of Terms

By selecting "I Accept the Terms of Service," you agree to these Terms for Lane Pilot ("the Service"). If you accept on behalf of a business, you confirm that you are authorized to bind that business. If you do not agree, do not use the Service. These Terms apply to all users, including technicians, service advisors, shop owners, and API consumers.

3. Description of Service

Lane Pilot is an advanced diagnostic platform for automotive professionals. The Service provides CAN-Bus fault analysis, repair plan generation, and related tools. The Service supports the judgment of qualified automotive technicians. Feature availability depends on your plan, browser, compatible hardware, and vehicle; access to the web app does not guarantee support for any particular vehicle command.

4. Critical Disclaimer — Diagnostic Output & Liability

Lane Pilot is a machine-assisted diagnostic reference tool, not a replacement for official manufacturer service data, OEM repair manuals, or professional engineering judgment.

• Verification Required: You acknowledge that automated diagnostic models can generate errors. You agree to verify all torque specifications, wiring diagrams, pinout assignments, voltages, and repair procedures against the official manufacturer workshop manual for the specific vehicle before application.
• No Warranty: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that diagnostic output is 100% accurate, complete, or current for any vehicle make, model, or year.
• Repair Decisions & Safety: You are responsible for independently evaluating diagnostic output, obtaining authorization to work on the vehicle, and using safe repair procedures. Suggestions do not establish that a repair is necessary, complete, or safe. Nothing in these Terms excludes liability that cannot lawfully be excluded.
• Not a Substitute: The Service does not replace OEM scan tools, factory service information subscriptions, or the professional judgment of a qualified automotive technician. Diagnostic output is provided as a starting point for qualified professionals only.

5. Optional Vehicle Connections & Commands

If you connect compatible diagnostic hardware and use an available command feature, commands may clear fault codes and freeze-frame data, change supported vehicle settings, or activate components such as fans, windows, or parking brakes. These actions can cause injury or damage if used incorrectly. These conditions apply when you use those features; opening an account does not mean you have connected a vehicle or enabled vehicle controls.

Before issuing a command, obtain the vehicle owner’s authorization, verify the procedure against manufacturer service information, and ensure the vehicle, work area, and people nearby are safe. Only perform tests for which you are trained and equipped. Follow the feature-specific warnings and confirmations; accepting these Terms does not authorize a vehicle command or bypass a safety check.

6. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

7. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract the Diagnostic Engine models or training data.
• Share your account credentials with unauthorized individuals.
• Use the Service to generate deliberately false or misleading repair documentation.
• Exceed your plan's rate limits or attempt to circumvent metering.
• Use automated bots, scrapers, or scripts to access or copy data from the Service.

8. Uploaded Content & Diagnostic Imagery

When you upload photos, videos, or files to the Service for diagnostic analysis:

• Ownership: You retain all ownership rights to your uploaded content. We do not claim ownership of your photos, scan data, or diagnostic files.
• Limited License: By uploading content, you grant Lane Pilot a limited, non-exclusive license to process the content solely for the purpose of providing diagnostic analysis within the Service.
• No Sale of Imagery: We do not sell, license, or distribute your uploaded diagnostic photos or scan data to any third party for commercial purposes.
• Sensitive Information: You are responsible for ensuring uploaded photos do not contain personally identifiable information (PII) such as license plates, customer identification documents, or financial information. Lane Pilot is not liable for PII you voluntarily upload to the Service.
• Retention: Uploaded diagnostic images are retained for 12 months from the date of upload, after which they are permanently deleted. This matches the retention stated in our Privacy Policy.

9. Vehicle Data & OBD-II Telemetry

When you connect a vehicle via the OBD-II Web Scanner or manually enter vehicle data:

• VIN Data: Vehicle Identification Numbers (VINs) are processed to retrieve vehicle specifications and decode DTC fault codes. VINs are stored in your encrypted diagnostic session and are never shared with third parties except as disclosed in our Privacy Policy.
• Live Telemetry: OBD-II PID data (engine RPM, coolant temperature, fuel trims, etc.) is transmitted from your browser to our servers for diagnostic analysis. This data is processed in real-time and stored within your session record.
• No Vehicle Tracking: Lane Pilot does not use VIN or telemetry data to track vehicle location, driving behavior, or owner identity.

10. Third-Party DMS Integrations

Lane Pilot offers optional integrations with third-party Shop Management Systems ("DMS Providers") including Shopmonkey, Tekmetric, and others:

• Opt-In Only: DMS integrations are activated solely at the discretion of the shop owner or administrator. No data is shared with a DMS Provider until you explicitly configure and enable the integration in Shop Settings.
• Data Transmitted: When you push diagnostic findings to your DMS, Lane Pilot transmits the diagnostic summary, recommended repairs, safety warnings, and inspection status (pass/fail/monitor) to your DMS Provider via their REST API.
• Your DMS Credentials: Your DMS API keys are stored encrypted at rest in our database. Lane Pilot staff does not have visibility into your plaintext API credentials.
• DMS Provider Terms: Your use of Shopmonkey, Tekmetric, or any other DMS Provider is governed by that provider's own Terms of Service and Privacy Policy. Lane Pilot is not responsible for how your DMS Provider handles data after it is received by their platform.

11. Subscriptions & Billing

• Billing Cycle: Subscriptions are billed on the monthly or annual schedule shown at checkout for your selected plan. Review the price, billing interval, and renewal date before subscribing.
• Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle at the then-current rate unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.
• Shop Trial: A shop may try the Shop plan free once, for 30 days. The trial includes 50 diagnostic sessions shared by all of the shop's logins. They do not reset; when they are used up, new diagnoses need a subscription. No payment method is collected, and nothing is charged when the trial ends. One trial is available per shop, per account, and per business phone number, and we may end a trial that breaks this rule or these Terms. When the trial ends, the account returns to the free plan and keeps its vehicle history, session records, and reports, which are retained as described in our Privacy Policy. • Session Metering: Usage is measured in diagnostic sessions. Your included session allowance resets monthly, including on annual subscriptions, as described for your plan.
• Overages: Some plans have a hard usage cap with no overage charges; others provide additional sessions in paid blocks. The allowance, block size, price, and any required authorization are those disclosed for your plan before you incur a charge.
• Cancellation: You may cancel your subscription at any time via the "Manage Subscription" portal in your dashboard. Cancellations take effect at the end of the current billing cycle. Except where required by applicable law or expressly offered at checkout, we do not provide refunds for partial subscription periods.
• Payment Processing: All payments are processed securely by Stripe. We do not store your credit card information on our servers.

12. Intellectual Property

The Lane Pilot platform, including its software, design, database schema, Diagnostic Engine architecture, proprietary analysis workflows, and documentation, remains the exclusive property of Lane Pilot LLC.

You retain ownership of any data you input into the Service (vehicle data, diagnostic queries, repair notes). We do not claim ownership of your data.

• Limited License: We grant you a limited, non-exclusive, non-transferable license to use the Service for your own professional automotive repair purposes.
• No Scraping: You agree not to use automated bots, scrapers, or scripts to access or copy data from the Service.

13. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PLATFORM-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LANE PILOT LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, GOODWILL, DATA, OR USE ARISING OUT OF YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LANE PILOT DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THE WARRANTY DISCLAIMERS, LIABILITY LIMITS, AND INDEMNITY IN THESE TERMS DO NOT EXCLUDE OR LIMIT LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, RECKLESS CONDUCT, OR ANY LIABILITY OR STATUTORY RIGHTS THAT APPLICABLE LAW DOES NOT ALLOW TO BE EXCLUDED OR LIMITED.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Lane Pilot LLC and its officers, directors, employees, and agents against third-party claims and reasonable costs only to the extent caused by your unlawful use of the Service, willful misuse, or infringement of third-party rights through content you submit. This obligation does not apply to claims caused by Lane Pilot’s negligence or other misconduct. Ordinary use of diagnostic suggestions does not, by itself, create an obligation to indemnify Lane Pilot.

16. Termination

• We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
• You may terminate your account at any time by canceling your subscription and ceasing use of the Service.
• Upon termination, your right to use the Service will immediately cease. The Intellectual Property, Warranty Disclaimer, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law sections shall survive termination.

17. Dispute Resolution

• Informal Resolution: Before filing any formal proceeding, you agree to first contact us at service@lanepilot.io and attempt to resolve the dispute informally for at least thirty (30) days.
• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the Commonwealth of Pennsylvania.
• Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Lane Pilot LLC.
• Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
• Judicial Forum: For any claim not subject to arbitration — including an action to compel arbitration, to enforce an arbitration award, or to seek injunctive relief for infringement or misuse of intellectual property — the federal and state courts located in Pennsylvania shall have exclusive jurisdiction, and both parties consent to venue there.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.

19. Privacy

Our Privacy Policy describes how we collect, use, share, and retain account information, uploaded content, and diagnostic data, and how to exercise your privacy rights. Acceptance of these Terms is not consent to optional advertising or other data uses that require separate consent.

• Diagnostic Telemetry: Lane Pilot collects anonymous, aggregated vehicle sensor metadata (ECU addresses, parameter identifiers, and response byte counts) to improve diagnostic accuracy across the platform. This data is derived from standardized OBD-II protocols and contains no personally identifiable information, full vehicle identification numbers, shop identifiers, or technician data. You may opt out of this data sharing at any time via the scanner settings.

20. Changes to These Terms

We will identify revised Terms by their version and updated date. When we require acceptance of a new version, we will explain the material changes and ask you to accept before continuing to use the Service. A revised version takes effect for you when you accept it. You can review the current Terms at /terms and contact us with questions before accepting.
